These Terms & Conditions (“Terms”) govern your use of the zDryve website and participation in any vehicle rental or leasing program offered by WHC Fleet Services LAS, LLC dba zDryve (“zDryve,” “we,” “our,” or “us”).
1. Use of Website
By accessing this website, you agree to use the site only for lawful purposes, provide accurate and complete information, and not misuse or interfere with website functionality.
2. Rental Program Overview
zDryve provides vehicle rental and leasing programs for qualified drivers. Participation is subject to approval based on eligibility criteria, execution of a separate rental or lease agreement, and compliance with all program requirements. Submission of an application does not guarantee approval or vehicle availability.
3. Independent Contractor Relationship
zDryve does not employ drivers. Drivers who rent vehicles operate as independent contractors and are not employees, agents, or representatives of zDryve. Drivers are solely responsible for their work, earnings, and use of third-party platforms.
4. No Earnings Guarantee
zDryve does not guarantee any level of income or earnings. Driver earnings depend on factors outside of zDryve’s control, including market demand, platform activity, and driver effort.
5. Payments & Fees
Rental fees are typically billed on a weekly basis. Additional fees may apply, including for late payments, damages, tolls, or violations. All payment obligations will be outlined in your rental agreement.
6. Payment Processing
zDryve may use third-party payment processors to facilitate billing and transactions. By participating, you agree to the terms of such providers. zDryve is not responsible for delays or errors caused by third-party systems.
7. Vehicle Use
Drivers agree to operate vehicles in compliance with all applicable laws, use vehicles only for approved purposes, and not allow unauthorized individuals to operate the vehicle.
8. Insurance & Responsibility
Insurance coverage, if provided, is subject to specific terms. Drivers may be responsible for deductibles, vehicle damage, loss or theft of equipment, and any tickets, tolls, or violations.
9. Maintenance & Condition
Drivers must maintain vehicles in good condition, follow required maintenance schedules, and report any issues promptly.
10. Equipment Responsibility
Drivers may be responsible for loss, theft, or damage to equipment provided with the vehicle, including tablets, cameras, or telematics devices.
11. Vehicle Availability
Vehicle inventory is limited and subject to change at any time.
12. Electronic Communications
By submitting information through this website, you consent to receive electronic communications, including agreements, disclosures, and notices.
13. Limitation of Liability
To the fullest extent permitted by law, zDryve shall not be liable for loss of income, business opportunities, indirect damages, or issues related to third-party platforms.
14. Termination
zDryve reserves the right to deny applications or terminate participation for failure to comply with program requirements.
15. Intellectual Property
All website content is the property of zDryve and may not be used without permission.
16. Governing Law
These Terms are governed by the laws of the State of Nevada.
17. Changes to Terms
zDryve may update these Terms at any time. Continued use of the website constitutes acceptance of those changes.
